MyALDI App Terms of Use

Thank you for downloading the MyALDI mobile Application ("App") or using the MyALDI website which is operated by ALDI Stores (A Limited Partnership) ABN 90 196 565 019) (“ALDI”). These terms relate to the App and the website application (the Terms of Use).

Access to and use of this App is provided strictly subject to these Terms of Use. By downloading and using this App you accept these Terms of Use. If you do not agree, please uninstall or cease using the App immediately.

Use of the App

Subject to these Terms of Use, ALDI grants you a personal licence to use the App for non-commercial purposes on any iPhone, iPad or other compatible portable electronic device that you own or control. This licence to use the App is not exclusive to you and cannot be transferred to another person. The right to use this App can be revoked by ALDI at any time.

Except as otherwise expressly stated in these Terms of Use and to the full extent permitted by law, this App and all information contained within it regarding or relating to ALDI and its related entities, products and services is provided "as is" and on an "as available" basis. ALDI does not make any representations or endorsements in respect of the information contained on the App.
ALDI will strive to ensure that all information available on the App is up to date, accurate and complete but sometimes things can go wrong. This means that sometimes there may be a delay in information updating in the App or there may be an error. ALDI will endeavour to ensure that information is kept up to date and errors are addressed.

When you are using this App, your personal information may be collected by ALDI. The collection, use and distribution of such information will be in accordance with the Privacy Policy set out in the ALDI Employee Handbook. This means ALDI will collect information that you put into the App, but will treat it in accordance with the Privacy Policy and its obligations under Australian legislation.

Your conduct when using this App

When using this App, you must adhere to all of ALDI’s policies and expectations regarding appropriate conduct. This includes (but is not limited to) ALDI’s policies as set out in the Employee Handbook prohibiting conduct such as bullying and/or harassment. You acknowledge and agree that failure to adhere to ALDI’s policies in using the App may lead to disciplinary action.

Personal Data Usage

In accordance with your agreement with your telecommunications provider, data download charges may apply to any download of the App and to any upgrades of the App you request. In addition, your telecommunications provider may impose data download charges for the ongoing use of the App.

Safety

You must not operate the App while driving, operating any equipment, in the vicinity of heavy duty machinery or vehicles (i.e. forklifts or trucks) or during the course of your work duties for ALDI.

You acknowledge and agree that:

• you will not use the application whilst driving a vehicle;

• you will not operate the application while operating any equipment;

• you will not operate the application in the vicinity of heavy duty machinery or vehicles; and

• you will not operate the application while performing your work duties (other than breaks).

Liability

Our lawyers have told us to tell you that your use of this App is at your own risk. In legal speak - to the extent permitted by law, neither ALDI nor any party involved in creating, producing or delivering this App accepts any liability for the accuracy, timeliness or completeness of the information contained in this App or any responsibility for any errors or omissions in the content in this App whether or not ALDI is aware of such errors or omissions. Neither ALDI nor any party involved in creating, producing or delivering this App accept any liability for any direct or indirect loss, or loss or corruption of data arising out of your access to, or use of, or inability to use or access this App, whether arising in negligence, tort or contract.

ALDI does not guarantee that the functions contained in this App will be uninterrupted or error free and does not warrant that this App or its server is free of computer viruses, bugs or other harmful components or that defects will be corrected even if ALDI is aware of them.

Indemnity

The lawyers also wanted us to explain that as a user of the App, you agree to indemnify ALDI. This means that you agree to compensate ALDI, its partners, officers, agents, licensors, suppliers, lawyers and all other persons providing information in the App for all liability, damage, loss, costs, fees (including reasonable legal fees) arising out of or in connection with any violation of these terms and any and all unauthorised use you may make of any materials on this App. You acknowledge the unauthorised use of the contents (for example, unauthorised disclosure of information) could cause irreparable harm to ALDI and that in the event of unauthorised use, ALDI shall be entitled to an injunction in addition to any other remedies available at law or in equity.

Cookies

ALDI may collect and process the following information automatically when you use the App:

• the Internet Protocol (IP) address used to connect your device to the internet, your login information, details of the type of device you use, a unique device identifier (for example, your device's IMEI number, the MAC address of the device's wireless network interface, or the mobile phone number used by the device), mobile network information, your browser type and version, your time zone setting, browser plug-in types and versions, operating system and platform;

• information about your visit, including the full Uniform Resource Locators (URL) clickstream to, through and from the App (including date and time), page response times, download errors and bugs, the length of your visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the App;

• information stored on your device which you choose to share with ALDI (such as contact information, friend lists, login information, photos, videos or other digital content);
• any details of your current location which you may choose to share with ALDI (you can choose to turn this off at any time); and

• information provided to us by third parties (including, for example, business partners, sub-contractors in technical, wi-fi, advertising networks, analytics providers and search information providers).

How ALDI uses cookies

ALDI may use cookies in associated with this App to:

• personalise the App to you. For example, to try and ensure that language and region displays are correctly configured for you;

• allow you to use the App in a way that makes your browsing experience more convenient;

• improve the App. For example, knowing how App users navigate the App and use its features allows ALDI to streamline the user experience, speed up searches, identify bugs, make enhancements and ultimately get you to the right page faster;

• review the popularity of our content and advertisements with reference to platform, location and other related factors;

• estimate our audience size and usage pattern;

• provide faster and more personal service by collecting information in respect of any accounts which you have on the App;

• collect anonymised information about the websites from which users have travelled to the App;

• store information about any preferences which you set, so we can do things like greet you personally and speed up your log-in when you come back to the App;

• identify which of your device(s) you use to access the App or any account which you have registered on it; and

• prevent credit fraud and various forms of cyber-crime

The cookies ALDI uses:

• may persist on your device between visits to the App, so that, for example, we can identify you when you visit again; and

• may be provided either by ALDI or by third-party service providers (such as analytics and search engine providers).

You can set your browser to accept or reject certain cookies or, if you prefer, you can set your browser to alert you each time a cookie is detected. Previous cookies that have been stored on your device can also be deleted. However, if you block our cookies or you subsequently delete a cookie that has been placed, it will not be possible for you to use the App effectively as our systems rely on cookies to identify you as the user.

Modification of Terms

ALDI reserves the right to add to, change or discontinue the products, services, programs and information contained in, or any other aspect of, this App at any time and without liability. Please check this section regularly for changes proposed by ALDI to these Terms of Use as your continued use of this App will signify your acceptance of any proposed changed terms. If you do not agree you should uninstall the App immediately.

Other rights

Unless otherwise noted, materials on this App are protected as copyright, trade names, trade marks or are other intellectual property owned by ALDI and/or its related entities or by other parties that have licensed their material to ALDI or which ALDI is entitled to use to describe the products shown ("Intellectual Property Rights"). Other than viewing and downloading content via the App for purposes expressly permitted by these Terms of Use, you do not have the right to use these Intellectual Property Rights without the written permission of ALDI. You agree that you will not use this App for any unlawful purpose. You will not violate or attempt to violate the security of this App.

ALDI reserves its rights, including its Intellectual Property Rights, in relation to your use of the App.

 

Restrictions on use

The use of the materials in this App is only for informational purposes and purposes related to your employment at ALDI and use of ALDI's services. You agree you will not distribute, publish, transmit, modify, display or create derivative works from or exploit the contents of this App in any way.
You must not reverse engineer, decompile, disassemble, or extract any element of and/or otherwise discover any source code, algorithms, methods or techniques embodied in the App. You must not modify, pledge, sublicense, rent, lease, or create derivative works based on the App, including its user interfaces. The source and object code of the App constitute a trade secret of ALDI and must not be accessed, examined or shared except as permitted by law.

Term and Termination

This Agreement commences when you click "install" as part of the installation of the App and continues until terminated by either party. ALDI may cease providing the App (or any part of it) at any time in its discretion. You may terminate your use of the App at any time by uninstalling the App from your device.

If your employment with ALDI is terminated, your rights to log into and use the App and web application may be disabled.

Governing law

These terms will be governed by the laws of New South Wales, Australia, and shall be subject to the non-exclusive jurisdiction of the courts of New South Wales, Australia. In the event that any of the terms are found to be unenforceable under New South Wales law, this will not affect the remainder of these terms.
